Scope

This document [hereinafter also referred to as the Terms and Conditions], along with other documents referenced herein, defines the terms and conditions governing the use of the website (https://pl.faina.shop/) and making purchases through it. Before placing an order, the User is required to read and accept the Terms and Conditions. Once accepted, the provisions of these Terms and Conditions are binding on the order placed. The Terms and Conditions may be subject to change, but changes will not apply to the provisions of the Terms and Conditions accepted by the User for each order already placed.

Conclusion of the Contract

The user may place an order via the website by adding an item displayed on the site to the shopping cart and then proceeding to payment by placing an order with the obligation to pay.

Placing an order constitutes an offer by the user to conclude a sales contract. The items on the website are described in detail; in particular, the user can review the product specifications
(including, among other things, size, color, material, and cut).

When placing an order, the user has the option to create an account or proceed with the purchase as a guest (i.e., an unregistered user).

After the user places an order, we will send a confirmation of receipt to the email address provided in the order. This confirmation does not yet constitute acceptance of the offer. Once the order
has been processed and accepted, we will send the user an order acceptance confirmation along with the delivery details.

We reserve the right to cancel the order in whole or in part if, during processing, it becomes apparent that the ordered product is not in stock and cannot be shipped to the customer. In such a case,
the user will be promptly informed, and the price paid for that part of the order will be promptly refunded.

Sales Agreement

The information provided on the website does not constitute an offer under the Civil Code, which means, among other things, that we reserve the right to refuse to conclude a contract in particularly
justified cases, especially to protect our assets.

The contract is concluded in Polish.

Delivery

Goods marked as "available for delivery" are shipped no later than the third business day (the day we
hand the goods over to the shipping company) after receipt of the full purchase price, including VAT and shipping costs.

Delivery to addresses in Poland typically takes approximately 1-2 business days, and to addresses in other countries approximately 3-5 business days.

We reserve the right to make partial deliveries if this proves advantageous for speedy processing or is otherwise justified. In the event of partial deliveries, we will cover the additional shipping costs. This will not incur any additional costs to you.

If, after sending the order confirmation, we are unable to deliver the ordered goods due to our supplier's failure to fulfill its contractual obligations through no fault of our own, we reserve the
right to withdraw from the contract. In such a case, we will inform you immediately and refund the order amount.

Right of Withdrawal

A consumer user has the right to withdraw from the concluded contract within thirty (30) days of receiving the order without providing a reason. A sample withdrawal form is attached to these Terms and Conditions.

Returned goods must be returned within 14 days of submitting the declaration of withdrawal. The cost of returning the goods is the user's responsibility. Refunds will be made within 14 days of receiving the declaration, provided that we may withhold the refund until we receive the returned goods or the user provides proof of sending them back.

If the returned goods show signs of use beyond the necessary inspection of their features and functionality (e.g., worn clothing, torn labels, stains), the user is responsible for any diminished
value of the goods.

Prices

All prices are in PLN or EUR and include VAT. Shipping costs are added to the product price, as listed in the "Shipping and Payment Methods" tab.

Payment Terms and Invoices

We accept payments through Shopify Payments, which supports various payment methods, including Visa, MasterCard, American Express, Apple Pay, Google Pay, Klarna, Shop Pay, Union Pay, Maestro, and BLIK.

 a) Credit and Debit Card Payments

We accept Visa, MasterCard, American Express, and Maestro. When placing an order, you must provide your card number, expiration date, and security code (CVV). Your card will be
charged at the time of purchase, and order confirmation will be sent to your email address.

b) Digital Wallets and Alternative Payment Methods

You can complete your purchase using Apple Pay, Google Pay, Klarna, Shop Pay, Union Pay, or BLIK.

All transactions are securely processed by Shopify Payments, ensuring the protection of your payment information.

After processing and accepting your order, we issue an invoice for the purchased items. The invoice will be sent to the email address provided in the order.

Complaints

The user has the right to file a complaint regarding defective goods in accordance with applicable regulations. In the event of a complaint, please provide proof of purchase in the form of an invoice and send the goods in question, along with a copy of the invoice, to Faina Lifestyle sp. z o.o. at the following address:

Normal wear and tear of goods does not constitute grounds for claims. We are not liable for damage caused by improper use.

Reservation of Ownership

We reserve title to the goods until the full purchase price is paid. The risk of accidental loss or damage passes to the customer upon delivery of the goods.

Services Provided Electronically

1. Through the website, Faina
Lifestyle sp. z o.o. provides the following services free of charge
electronically in connection with the purchase process:

a.  account management

b.  providing a contact form

c.  information services, consisting of presenting content on the website

d.  newsletter

The contact form service allows the customer to contact the seller via messages via a form posted on the website.

Information services allow the customer to view information about the seller or products available on the website.

The service agreements referred to in paragraph 1 (b) and (c) above are concluded when the customer begins using a specific service and terminate when the customer leaves the website or otherwise ceases to use the individual services.

As part of the account management service (i.e., in connection with registration or use of the account), Faina Lifestyle sp. z o.o. allows customers to:

a.  access order history;

b.  manage customer personal data assigned to the account, including the ability to add and edit customer data with delivery addresses, etc.;

c.  create wish lists;

The customer may terminate the account management agreement at any time by sending the seller an email requesting account deletion.

Furthermore, submitting a request to delete the customer's personal data, including the data required to manage the account, will result in the termination of the account management agreement.

The customer's consent to receive the newsletter is voluntary and optional and does not condition the conclusion of an account management agreement or sales agreement with the seller. The
customer may opt out of the service at any time by withdrawing consent to receive commercial information, which does not affect the lawfulness of data processing prior to its withdrawal.

Personal data

All information can be found in the Privacy Policy tab. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

Applicable law

Any disputes arising from or related to this agreement are subject to Polish law. In the case of agreements concluded for a purpose that cannot be attributed to the authorized party's professional or commercial activity (agreements with consumers), such a choice of law applies
only to the extent that it does not deprive the consumer of the protection afforded by the mandatory provisions of the country where the consumer has their habitual residence.

The Right to change the Regulations

The User is obligated to comply with the provisions of the Terms and Conditions in force at the time of using the online portal or placing an order, subject to exceptions arising from legal provisions or decisions of competent public or local government authorities, which may require retroactive amendments to the Terms and Conditions or the privacy policy. However, such amendments will not apply to orders placed before their effective date, unless mandatory provisions provide otherwise.

Effective date: August 1, 2025.
